THE GROUND FOR DIVORCETS
Mrs. Prapai Tanonkaew vs. Mr. Kitipoom Phetyoi

The Defendant sent a letter of complaint to the Plaintiff’s superior and instructor that the Plaintiff committed adultery with other woman. This matter is regarded as the personal behavior of the Plaintiff. The Defendant who is the wife of the Plaintiff has the right to express her love and jealousness upon her husband. Her request to the Plaintiff’s superior and instructor to admonish the Plaintiff to think of his family is not regarded as humiliating the Plaintiff’s reputation. No severe disciplinary punishment was executed.

SUBLET AGREEMENT TRANSFER THE LEASED PROPERTY
Ms. Suwanna Sae-heur vs. Mr. Komrat Maliwongse

The 30 years land leased contract indicated that leased for construction the buildings and there was no tea money for the lease. T, the former lessor and the three Defendants did not designate the construction period and the amount of the buildings that the three Defendants is going to build up on the leased land. From the contract, it is cleared that the three Defendants have right to construct the building in any quantity and at any time during the leased period. And in setting the new agreement on constructing period.

The plaintiff claims for compensation in cause of action on tort. The defendant argued that the plaintiff’s lawful father made a contract of compromise regarding damages so there is no current right to claim the compensation of the plaintiff. The Court judged that the legal representative of the Plaintiff made the contract of compromise relating to the property of the minor without Court consent which is a void act. The right to claim has therefore not expired.

Donations of Counterfeit Items to Be Given to the Poor

The Customs Department and local consumer goods distributors have tentatively agreed to donate counterfeit brand-name clothes to the poor.

To dissuade Thailand intellectual property law violations, the Department destroys millions of baht worth of counterfeit goods. However, the Department is inclined to donate certain counterfeit goods to the poor instead as a way of giving back to the community and a means to reduce global warming from burning the goods.

Currently, seized products are separated into three categories as follows:
1) hazardous products to be destroyed such as batteries and pharmaceuticals,
2) donated products comprising clothes, toys, and some electrical appliances, and 3) recycled products including watches.


Import Duty on Imported Steel Entitled to Tax Benefits

Companies importing quality steel from Japan for the automotive industry will be entitled to low or even zero import duties under the Japan-Thai Economic Partnership Agreement (JTEPA). The Thailand Finance Minister will seek Cabinet approval for this measure shortly. The JTEPA became effective in November 2007 and covers the automobile, electronics, and chemicals industries.

The agreement requires hot-rolled steel, an essential ingredient for the manufacture of cold-rolled steel in Thailand, to have import duties waived, according to media sources. However, the wording in the agreement was unclear, causing many persons to believe that only automobile assemblers would receive benefits from the JTEPA.

Nevertheless, the Deputy Finance Minister’s recent visit to Japan clarified the interpretation of beneficiaries under the JTEPA to include any company importing steel for auto production. The beneficiaries will comprise primarily the Japanese automobile makers, as these have a large stake in the Thai market. 


Thailand to Benefit from Asean-South Korea FTA

The completion of the comprehensive Asean-South Korea Free-Trade Agreement is expected to benefit Thailand’s economic interests in Korea in the areas of office paper, entertainment, medical tourism and food.

Thailand’s food export to Korea, specifically in shrimp and seafood, is anticipated to increase significantly when the FTA takes effect in October.

Other MoUs and agreements between the two countries, including a deal concerning Thai paper exports, will boost such export to $516 million USD per year.

Furthermore, a Medical Tourism MoU was signed which should expand the Korean clientele base obtaining hospital services in Thailand to 10,000 per year.


Asean-South Korea FTA

3 June 2009

South Korean and Asean trade ministers completed the agreement to liberalize investment on Tuesday, the final part of a pact covering trade in goods and services which is already in effect. The countries foresee the FTA will double two-way trade to $150 billion USD by 2015.

A minister of South Korean’s finance ministry reportedly stated that the country views Asean as an export market which can offset a stagnant economy in developed lands.
