The Defendant sent a letter of complaint to the Plaintiff’s superior and instructor that the Plaintiff committed adultery with other woman. This matter is regarded as the personal behavior of the Plaintiff. The Defendant who is the wife of the Plaintiff has the right to express her love and jealousness upon her husband. Her request to the Plaintiff’s superior and instructor to admonish the Plaintiff to think of his family is not regarded as humiliating the Plaintiff’s reputation. No severe disciplinary punishment was executed.
SUBLET AGREEMENT TRANSFER THE LEASED PROPERTY

The 30 years land leased contract indicated that leased for construction the buildings and there was no tea money for the lease. T, the former lessor and the three Defendants did not designate the construction period and the amount of the buildings that the three Defendants is going to build up on the leased land. From the contract, it is cleared that the three Defendants have right to construct the building in any quantity and at any time during the leased period. And in setting the new agreement on constructing period.
The plaintiff claims for compensation in cause of action on tort. The defendant argued that the plaintiff’s lawful father made a contract of compromise regarding damages so there is no current right to claim the compensation of the plaintiff. The Court judged that the legal representative of the Plaintiff made the contract of compromise relating to the property of the minor without Court consent which is a void act. The right to claim has therefore not expired.

Tax Incentive for New Home Buyers

On 20 January 2009, the government announced tax incentive measures intended to stimulate the stagnant real estate market. One such measure is a personal income tax deduction on payments of up to 300,000 baht for purchases of new homes in the 2009 tax year. The government resolution is not yet law, but will be published in the Government Gazette and become effective thereafter.
At present, the current law allows individual taxpayers to deduct 100,000 baht per year on mortgage interest payments. |
Additional Protection for Consumers

Additional regulations under the Trade Competition Act will be issued by the Ministry of Commerce on Monday, according to press sources. These regulations are intended to protect consumers and suppliers from retail giants seeking unfair advantage.
At present, retailers are permitted to set their own trade conditions without regard for consumers. However, the new guidelines will address the problems of unfair price dumping and other trade conditions.
Sources report that the ministry receives complaints of suppliers being forced by large retailers to reduce their prices to the level of production costs, leading to price dumping.
Under the Trade Competition Act, a retailer who engages in unfair trade practices faces imprisonment of up to 3 years and/or a fine of 6 million baht.

Export Tariff Reductions to Be Proposed

A proposal by the Commerce Ministry to reduce export tariffs will be submitted for Cabinet review next week. The measure is intended to prevent export contraction of 15 percent this year and help exporters. If approved, it would be enforced until the end of this year.
The proposal would reduce import taxes on raw materials for electronics, electrical appliances, and automobile and parts by 3-5 percent, and 2 percent for other industries.
Exports of electronics, electrical appliances, and automobile and parts fell 26.9 percent, 28.6 percent, and 37.2 percent, respectively.
The reduction in tariffs would stimulate the export sector by growth of from 0-3 percent, and thereby boost the economy, although the government’s tax revenue base would decrease by up to 102 billion baht. |
