California Sues Nebraska Over Real Estate Law

The owner of a property-listing website in California is suing Nebraska to dispute a state requirement that she obtain a license to market homes in the state.

Leslie Young filed the federal lawsuit seeking a permanent injunction to stop Nebraska from enforcing the law, which she says is a violation of her First Amendment rights.

Her Elist.me website features advertisements for properties listed on ForSaleByOwner.com. Young says in the lawsuit that she is merely publishing information about the listings and doesn’t get a commission if a home sells and that she doesn’t provide other services to homeowners.

The Nebraska Real Estate Commission has told Young she must stop marketing properties in the state until she obtains a real estate license.
Her site shows her title as “advertising broker” and her attorney said Young doesn’t act as a property broker and simply provides sellers a way to advertise.

There is no license required to act as an agent for Thai real estate and the profession is therefore “open” to ethical and non-ethical individuals.
