Colorado’s new law makes texting and driving legal while simultaneously toughening the penalties for the act.

Under the changes, a driver will only be pulled over if, while texting, he is careless at the wheel.

According to the Denver Channel, “For officers to pull someone over and write a ticket, ultimately sending them to court as part of the new law, there are two required parts.

First, officers must see the driver typing on the phone and second, the officer has to notice careless driving.”

Some have criticized the law for giving police officers the power to decide when a driver is being “careless”.

Driver Nick Leblanc told the Denver Channel, “It’s a slippery slope, because it’s kind of up to the police officer and then you will have to fight that in court”.
