The plaintiff entered into an Agreement for purchase of house and land with the defendant and made a deposit of 250,000 baht. However, the defendant was unable to transfer ownership rights of the house and land to the plaintiff as stipulated in the Agreement because the defendant had sold the land to another person. The defendant offered sale of a new home to the plaintiff and agreed to credit the deposit to the sales price of the new home. The plaintiff agreed to purchase, but was again unable to transfer ownership of land.

The plaintiff, as first estate administrator of the decedent’s estate and creditor, entered into the Acceptance of Debt Agreement with the defendant (debtor) while the second plaintiff, who was another estate administrator, acknowledged and consented to the action, but did not sign as the second estate administrator. The defendant argued the Agreement was not valid due to not having the signatures of both joint estate administrators. However, according to Thai law, the Agreement does not require the signing of the creditor as party to the Acceptance of Debt Agreement to be valid.

Based on the mediated divorce agreement entered into by the plaintiff and the defendant, the defendant agreed to pay child support for the couple’s four children to the plaintiff of 400,000 baht. The defendant thereafter submitted a motion to the effect that his financial status worsened as a result of the economic downturn, and he was therefore unable to pay the child support payment according to agreement, and he requested that the court modify his child support payment by revoking the order or reducing the amount to 200,000 baht. The Appellate Court affirmed the denial of the motion based on the debt having already been incurred.


Mrs. Somjit Muangngam vs. Mrs. Urai Sungkagoon

The plaintiff filed a lawsuit claiming that the defendant constructed a bamboo fence which encroached, by 7 square wah, on the northern part of the plaintiff’s Thailand property, based on a map. In comparing the map as stated to the map from the plaintiff’s prior legal proceeding, it can be seen that the disputed land referred to in this case was a part of the land under contention in the former legal proceeding.
