Clause 31. Provisions outlined in Clauses 28 and 30 shall be used as criteria for considering grants for renewal of foreigner work permits as appropriate*

Clause 32. Upon receiving the application form for substitute certificate for a work permit under Clauses 4, 14, or 21, including all documents and evidence, the official shall issue a receipt of the application form to the applicant and submit the (aforementioned) application form, documents and evidence to the Registrar for (further) consideration.

The Registrar shall notify the applicant in writing of application results within 15 days upon receiving the application, including documents and evidence from the official. In the case of denial/disapproval of a substitute certificate for a work permit, the grounds for the decision shall also be clearly indicated in the application as well as the in the written notification of application results.

The substitute certificate for a work permit shall be issued following the format of a work permit, with the addition of a written note or stamp indicating “Substitute” in red ink, as well as the day, month and year of issue (of the substitution certificate) and the Registrar’s signature.

Clause 33. Provisions (outlined) in Clause 28 shall be used as criteria for considering grants/approvals of amendments or adding of job type or description outlined in Clauses 6, 16 or 23, (amendments to or adding of) employer(s) under Clauses 7, 17 or 24, (amendments to or adding of ) region or location of work under Clauses 8, 18 or 25, or (amendments to or adding of) conditions/particulars of granted work permit under Clauses 9, 19 or 26, depending on each case as appropriate.

Clause 34. In the case of work permit grantees wishing to apply for making amendments to or adding job type or description, or employers who are foreigners that are not craftsmen or professionals as listed in Article 8 and are seeking employment in the Kingdom: once the permit grantee has paid the fees for permit (applications*) and has submitted documents or evidence stating that the employer has already paid the employment fees, the Registrar shall proceed with making amendments to or adding of job type or description, employer(s), region or location of work, or conditions/particulars of the permit depending on each case.

Clause 35. Should suspicions concerning the documents or evidence attached to the application form annexed to this Ministerial Regulation arise, the Official or the Registrar has the authority to request additional documents or evidence for supporting *consideration/judgment.

Clause 36. Applications and notifications as outlined in this ministerial regulation shall be made in the region of the location of work as follows:

1. In the area of Bangkok: applications and notifications shall be made at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour
2. In other provinces: applications and notifications shall be made at the Provincial Department of Employment
3. Other locations specified by the Director-General

Clause 37. Foreigners applying for a work permit must receive the permit or substitution certificate in lieu of /for a work permit in person.
