เรื่องเสร็จที่ ๒๕๕/๒๕๕๔ บันทึกวิเคราะห ์สรุป สาระสำคัญของร่างพระราชบัญญัติเครื่องหมายการค(า (ฉบับที่ ..) พ.ศ. …. คณะรัฐมนตรีได้มีมติใหเสนอร่างพระราชบัญญัติเครื่องหมายการค้า (ฉบับที่ ..) พ.ศ. …. ต่อสภาผู้แทนราษฎร และสำนักงานคณะกรรมการกฤษฎีกาได้จัดทำบันทึกวิเคราะห์ สรุปสาระสำคัญของร่างพระราชบัญญัติตามมาตรา ๑๔๒ วรรคหา ของรัฐธรรมนูญแห่งราชอาณาจักรไทยดังต่อไปนี้ ๑. เหตุผลและความจำเป็นในการเสนอร่างพระราชบัญญัติ โดยที่ปัจจุบันการคุ้มคร้องเครื่องหมายการค้าในระดับสากล ได้มีการขยายขอบเขตการให้ความคุ้มครองไปยังเครื่องหมายประเภทใหม่ๆ ซึ่งบทบัญญัติของพระราชบัญญัติเครื่องหมายการค้า พ.ศ. ๒๕๓๔ ยังครอบคลุมไม่ถึง จึงสมควรขยายขอบเขตการให้ความคุ้มครอง เครื่องหมายการค้าดังกล่าว และปรับปรุงขั้นตอนตลอดจนระยะเวลาในการพิจารณาการขอจดทะเบียนเครื่องหมายการค้าให้มีความชัดเจนและรวดเร็วยิ่งขึ้น รวมทั้งปรับปรุงอัตราคาธรรมเนียมเกี่ยวกับเครื่องหมายการค้าให้มีความเหมาะสมยิ่งขึ้น ๒. สาระสำคัญของร่างพระราชบัญญัติ ร่างพระราชบัญญัตินี้เป็นการแก้ไขเพิ่มเติมพระราชบัญญัติเครื่องหมายการค้าพ.ศ. ๒๕๓๔ โดยมีสาระสำคัญ ดังต่อไปนี้ […]

พระราชบัญญัติ แก้ไขเพิ่มเติมประมวลกฎหมายวิธีพิจารณาความแพ่ง (ฉบับที่ ๒๗) พ.ศ. ๒๕๕๘ ภูมิพลอดุลยเดช ป.ร. ให้ไว้ ณ วันที่ ๑ กันยายน พ.ศ. ๒๕๕๘ เป็นปีที่ ๗๐ ในรัชกาลปัจจุบัน พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดช มีพระบรมราชโองการโปรดเกล้าฯให้ประกาศว่า โดยที่เป็นการสมควรแก้ไขเพิ่มเติมประมวลกฎหมายวิธีพิจารณาความแพ่ง จึงทรงพระกรุณาโปรดเกล้าฯ ให้ตราพระราชบัญญัติขึ้นไว้โดยคำแนะนำและยินยอมของสภานิติบัญญัติแห่งชาติ ดังต่อไปนี้ มาตรา ๑ พระราชบัญญัตินี้เรียกว่า “พระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายวิธีพิจารณาความแพ่ง (ฉบับที่ ๒๗) พ.ศ. ๒๕๕๘” มาตรา ๒ พระราชบัญญัตินี้ให้ใช้บังคับเมื่อพ้นกำหนดหกสิบวันนับแต่วันประกาศในราชกิจจานุเบกษาเป็นต้นไป […]
